1. About Give Time
Give Time provides volunteer management software to UK museums and cultural organisations. Give Time is a trading name of B & D Studios Ltd, a company registered in England and Wales (company no. 17370321), registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.In these terms, “Give Time”, “we”, “us”, and “our” refer to B & D Studios Ltd. These terms govern your use of the Give Time platform, including the web application and any associated services. By creating an account or submitting an application, you agree to these terms.
2. Your account
- Invitation only: accounts are created by invitation from a museum administrator, following a successful application. You may not create an account without an invitation.
- Credential responsibility: you are responsible for keeping your password secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
- One account per person: you may not create multiple accounts or transfer your account to another person.
- Accurate information: you agree to provide accurate, current, and complete information and to keep it up to date.
- Minimum age: you must be 16 or older to create a volunteer account. If your organisation wishes to involve younger volunteers, please contact us to arrange admin-managed access rather than self-service sign-up.
3. Acceptable use
You agree not to:
- Use the platform for any unlawful purpose or in violation of any regulations
- Attempt to gain unauthorised access to any part of the service or its infrastructure
- Interfere with or disrupt the integrity or performance of the service
- Transmit any harmful, offensive, or disruptive content
- Reverse-engineer, decompile, or attempt to extract the source code of the platform
- Use automated tools to scrape, crawl, or otherwise access the service in bulk
4. Intellectual property
The Give Time platform, including its software, design, branding, and the “Give Time” name and logo, is owned by us or our licensors and is protected by copyright, trade mark, and other applicable laws. These terms do not grant you any right to use our branding, trade marks, or logos without our prior written consent. You retain ownership of any content you submit through the platform (see section 3), and grant us a licence to use it solely to provide the service to you.
5. Data processing
Your use of Give Time involves the processing of personal data. Please read our Privacy Policy for full details of what data we collect, how we use it, and your rights.
For museum administrators and organisations, a Data Processing Agreement (DPA) governs our processor relationship. You can review our standard DPA at give-time.org/dpa.
6. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted or error-free access. We may suspend the service temporarily for maintenance, updates, or reasons beyond our control. We will endeavour to give reasonable advance notice of planned maintenance where possible.
7. No warranties and limitation of liability
The service is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all implied warranties and conditions, including as to satisfactory quality, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Give Time shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the service.
Our total liability to you arising out of or in connection with these terms or your use of the service, however arising (including in contract, tort, or otherwise), is limited to the total fees you paid us in the 12 months immediately before the event giving rise to the claim.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
8. Indemnity
If you are a museum or organisation using Give Time, you agree to indemnify and hold us harmless against any claims, losses, damages, or costs arising from your own failure to properly vet, train, supervise, or manage your volunteers, including any safeguarding or DBS-check failures — Give Time provides scheduling software and does not carry out these responsibilities on your behalf (see our Safeguarding Policy).
9. Termination
Either party may terminate this agreement at any time. Museum administrators may deactivate your account. When your account is deactivated, any upcoming shift assignments will be cancelled and you will be notified by email. You may request account deletion by contacting us.
On deactivation, your data is retained under legitimate interest for up to 3 years for operational reporting purposes (see our Privacy Policy for the full retention schedule). You may request immediate deletion at any time. After 3 years of inactivity, your data is automatically and permanently removed. Audit logs are retained for 7 years as required by law.
10. Governing law
These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms, or their subject matter or formation, is subject to the exclusive jurisdiction of the courts of England and Wales.
